This is a binding legal agreement. Please clarify any questions or concerns before accepting the terms and conditions.

 

By accepting the terms and conditions you agree to the points below as well as waive certain legal rights, including the right to sue in circumstances outlined in the this agreement​. You therefore acknowledge that you have read this agreement and understood it, that you have executed this agreement voluntarily, and that this agreement is to be binding upon yourself, your heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives.

  1. You are 19 years or older.

​

Training, Injury & Liability:

 

  1. The Threshold and its respective directors, coaches, officers, committee members, members, employees, volunteers, participants, agents and representatives or anyone falling under the abmit of "The Threshold", is not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by an athlete.

  2. As with any athletic activity, there is a level of risk of injury whilst training for, and competing in races or events. The Athlete acknowledges this risk and agrees that his/her physical condition is adequate to safely train for races and events that The Threshold has been asked to assist with preparations for. If The Athlete has any doubt as to his/her physical condition, it is The Athlete’s responsibility to seek a professional medical opinion, and inform The Threshold of any findings that may impact his/her ability to follow his/her training programme.

  3. The Athlete further agrees that if, during training or competing, an activity causes pain, he/she is to stop immediately. However, when participating in any training programme, it is important to distinguish between normal muscular discomfort due to fatigue, and real musculoskeletal pain that precedes injury.

Pricing and Payment:

​

   1. The Threshold reserves the right to refuse a refund due to The Athlete no longer wanting or needing a requested training programme.

PRIVACY POLICY

The Threshold is committed to protecting and respecting the privacy of any and all personal data that it gathers in the course of doing business, as defined by the Personal Information Protection and Electronic Documents Act 2000 (PIPEDA), and any other applicable statutes. We collect only the essential information needed to perform the functions required by The Threshold. The Threshold has taken steps to ensure the information is stored in safe, secure locations with access only granted to those employees who require the information in order to perform their employment responsibilities.

This Policy explains when and why we collect personal data about you. We may change this Policy from time to time, but we will not treat your personal data in a fashion inconsistent with the Policy at the time your information is collected without notifying you. The Threshold collects information for the purpose of providing coaching services to the interested party, which will specifically meet his/her coaching criteria. The Threshold will not disclose any information about individual users. Any information provided by a client or prospective client to The Threshold is strictly confidential. The Threshold will not sell any information obtained or provided by a client to a third party for marketing or other purposes but we may use that information for marketing which may involve a third party, such as Facebook advertisements.

COLLECTION OF YOUR PERSONAL DATA

If you make a payment to us your payment details are not held by us but are collected by our third party payment processors, who specialise in the secure online capture and processing of such transactions.

  • Identifiers (name, email address, phone number): We use this information to communicate with you, deliver the services you have requested, and inform you of other products or services available from The Threshold and its affiliates.

  • Past training/coaching experience: We use this information to tailor a custom program or premium coaching offering.

  • Medical history: We use this information to understand all the contraints around your current medical circumstances to make sure your customer program or premium plan account for this.

  • Characteristics of protected classifications (age, gender): We use this information to ensure compliance with state, provincial, and federal law, deliver the services you have requested, and inform you of other products, services, or information available from The Threshold and its affiliates.

  • Internet or other electronic network activity information (IP address, browser type, domain name, access time, referring website address): We use this information to operate our service, to maintain quality of the service, and to provide general statistics regarding use of the The Threshold website.

The Threshold may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you.
